General Terms & Conditions for participation in DVGW Kongress GmbH events

1. Scope

Participation contracts for DVGW Kongress GmbH events are subject to the conditions described in the registration form, as well as to the following General Terms & Conditions. No participation contract for a DVGW Kongress GmbH event is valid until DVGW Kongress GmbH has confirmed in writing to the participant concerned that he or she may attend. As a rule, registrations for DVGW Kongress GmbH events are made via the Internet

Changes and/or additions to the contract must be made in writing. Verbal agreements are valid only if confirmed in writing by DVGW Kongress GmbH.

2. Performance

Participation fees are per person and event, plus statutory sales tax. DVGW Kongress GmbH reserves the right, even at short notice, to alter the event schedule described in the programme booklet or on the Internet, to replace individual lectures at an event, or to replace or cancel an event should circumstances so demand, and providing such changes may be deemed reasonable for participants. Changes of this kind do not imply any right to (partial) reimbursement, or to reimbursement of other expenses.

There is no entitlement to an event being carried out by a specific lecturer. This applies even if the event was announced in conjunction with the name of a specific lecturer.

DVGW Kongress GmbH is entitled to cancel or reschedule an event if the minimum number of participants is not achieved, if a lecturer becomes unavailable or ill, if the venue is closed or disrupted, or for reasons of force majeure. In the event of a cancellation, DVGW Kongress GmbH will reimburse the participation fee already paid. This does not provide a basis for further claims, in particular neither for reimbursement of travel and accommodation expenses, nor for loss of work and revenues. If a participant is unable to attend the event due to a change in date made by DVGW Kongress GmbH, he or she can withdraw from the contract free of charge.

Cancellations due to insufficient participant numbers shall be made at least 2 weeks before the event.

3. Refusal of registration

DVGW Kongress GmbH is entitled to refuse a registration for an event in justified cases.

4. Rights of use

Lectures and event documentation materials are protected by copyright law.

Participants are not permitted to take photos, or make videos or audio recordings on storage media of any kind, during an event.

Participants are not permitted to reproduce, distribute, exploit, publish or otherwise use or modify any event documentation materials they receive without the written consent of DVGW Kongress GmbH.

Rights of use shall be granted only by express written consent.

5. Due dates and payment

Participation fees are due following receipt of invoice. Should payment be delayed, DVGW Kongress GmbH is entitled to demand default interest in accordance with statutory provisions.

Payment must be made on account. Payment in cash or by cheque is not permitted. 

If a billing address is changed after an event booking has been made, DVGW Kongress GmbH is entitled to charge a service fee of EUR 15.

6. Cancellation of registrations by participants

Cancellations must be made in writing.

If participants cancel their registration at least 28 calendar days before the start of an event, DVGW Kongress GmbH will refund their participation fee in full.

If participants cancel their registration 27 calendar days or less before the start of an event, DVGW Kongress GmbH will keep the entire participation fee as compensation for expenses incurred.

Participants may nominate a replacement participant, providing no restrictive admission requirements apply. Participants who become ill are not entitled to reimbursement of their participation fee.

7. Liability

Aside from essential obligations arising from the contractual relationship, DVGW Kongress GmbH and its vicarious agents are liable only for damage that can be proven to be based on an intentional or grossly negligent breach of duty in the context of the contractual relationship, and that is still considered to be ‘typical damage’ that might have been foreseen. 

DVGW Kongress GmbH is not liable for damage incurred while travelling to or from the event location.

DVGW Kongress GmbH assumes no liability for the topicality, correctness, completeness or quality of the information provided in the events and/or event documentation unless DVGW Kongress GmbH can be proven to have acted with intent or gross negligence.

DVGW Kongress GmbH assumes no liability for damage and/or consequential damage of a material or immaterial nature resulting from the use or non-use of potentially incorrect and/or incomplete contents of the lectures and/or event documentation.

8. Creation and use of photographs and video / audio recordings by the organiser

At DVGW Kongress GmbH events, photographs and/or video or audio recordings of the audience and the lecturer can be made. These recordings are intended for publication, particularly in print and online media, for the purpose of appropriate reporting on the event.

Unless you object on site to the production and evaluation of such recordings, your consent to their use is deemed to have been granted. A corresponding notice displayed on site provides information about further details of use.

9. Data protection

Personal data transmitted to DVGW Kongress GmbH is stored and processed digitally for administrative purposes. By registering for an event, participants agree to the collection, storage and processing of their personal data.

This data is used within applicable legal limits to send participants information by post, email or telephone concerning their bookings and other offers by DVGW Group (DVGW e.V. and its subsidiaries). Use of the data is subject to consent having been given.

10. Applicable place of performance and jurisdiction

German law applies to the exclusion of UN purchase law. To the extent permitted by law, Bonn is agreed as the place of performance and jurisdiction.

11. Severability clause

If any individual clause of these Terms and Conditions should be ineffective in whole or in part, or if the contract is incomplete, the remaining Terms and Conditions shall remain valid and the ineffective or missing provisions shall be replaced by the relevant statutory provisions.

12. Withdrawal policy

Providing a participant counts as a consumer, he or she has the right to withdraw a registration in writing (letter, fax, email) within 14 days, without providing any reason. This period begins with receipt of notification, in writing, of withdrawal. No cancellation fee will be charged.

The right of withdrawal does not exist if the event booked has already commenced, regardless of whether the participant attends or not.
